Terms & conditions
These terms explain ordering from Sagga3D. Please review them and your complete order before choosing to purchase.
1. Acceptance and eligibility
By using our store or placing an order, you agree to these terms to the extent permitted by law. You must have legal capacity to make the purchase or act with appropriate authorization. Keep a copy of the terms and order confirmation for your records.
2. Product information
Read the product’s dimensions, materials, options, production estimate, and intended use. Photographs illustrate a design; colours, surface texture, fine details, and artistic interpretation may vary between individually produced pieces. Materially incorrect descriptions remain subject to applicable remedies.
3. Custom products and approvals
Choose the correct options and review your images, text, spelling, and dates. Where a design approval is requested, production may wait for your response. An approval confirms the details shown; it does not remove your rights concerning defects or misleading descriptions. Contact us promptly to request a correction before production.
4. Submitted images and text
You retain ownership of content you submit. You grant Sagga3D a limited permission to process, reproduce, adapt, and share it with service providers only as needed to assess, create, deliver, and support your order. You must have the necessary permissions from rights holders and appropriate consent from people represented. Separate express permission is required for marketing use.
5. Intellectual property and prohibited content
Do not submit content that infringes copyright, trademarks, privacy, or other rights, or that is unlawful, threatening, exploitative, or abusive. We may decline a project that cannot be produced lawfully or appropriately. Sagga3D’s original website content and designs remain protected; purchasing a physical object does not transfer reproduction rights.
6. Prices, taxes, and payment
Prices are shown in Canadian dollars unless identified otherwise. Review applicable taxes, shipping, discounts, and the total before purchase. Payment is handled through secure payment services; we do not collect raw card details. If a pricing error is discovered, we will contact you about correction or cancellation rather than silently increasing the charge.
7. Order acceptance
An acknowledgement confirms receipt of your request. Orders remain subject to payment confirmation, feasibility review, and availability. If we cannot accept or fulfil an order, we will explain the issue and arrange any required refund. We do not substitute a materially different product without your agreement.
8. Production
Made-to-order production begins after required information, payment, and approvals are received. The product or agreed quote provides the production estimate. Complex designs or incomplete references may affect timing; contact us about a fixed event date before ordering.
9. Shipping, delivery, risk, and title
Shipping estimates begin after dispatch and are distinct from production time. Confirm the delivery address and review the offered service. Carrier disruptions may affect estimates. Contact us if a parcel is lost or delayed. Responsibility for loss and transfer of title will be determined under the applicable contract and law; these terms do not transfer risks that legally remain ours.
10. Returns and cancellation
Because Sagga3D products are produced specifically for the customer, custom and made-to-order products are considered final sale once production has begun, subject to rights and remedies that cannot be excluded under applicable law. Ask promptly about cancellation or changes before production. Any separately published standard-product return conditions apply to eligible items.
11. Damage and defects
Contact Sagga3D within 10 calendar days of confirmed delivery regarding products that arrive damaged or materially defective. Provide your order reference, a description, and reasonable evidence such as photographs of the item and packaging. This reporting request does not shorten any non-excludable statutory remedy or limitation period.
12. Remedies and refunds
After reviewing the circumstances, we may offer a replacement, repair, reprint, partial refund, or refund as appropriate and consistent with applicable law. We will explain any return instructions and who pays return shipping. Approved refunds are returned through the original payment method where practical; processing time depends on the financial institutions involved.
13. Accounts and reviews
Keep account access secure and provide accurate information. Tell us promptly about suspected unauthorized use. Reviews must reflect your own experience, avoid private information, and comply with our content rules. Only eligible verified purchasers can submit product reviews; moderation may remove unlawful, abusive, irrelevant, or deceptive content.
14. Acceptable use and external services
Do not interfere with the store, attempt unauthorized access, scrape private content, or abuse forms and services. External identity, shipping, payment, hosting, and communications services support the store. Their relevant terms may apply to their services, without removing our responsibilities to you.
15. Privacy and electronic communications
Our Privacy Policy describes how we handle personal information and customization content. You agree to receive communications necessary for your order, including a durable written confirmation. Marketing subscriptions require a separate choice and can be withdrawn.
16. Liability and responsibility
Our obligations and your remedies remain subject to applicable law. To the extent permitted, neither party is responsible for losses that are legally too remote or caused solely by the other party’s unlawful conduct. No provision excludes liability or consumer rights that cannot lawfully be excluded. Any responsibility relating to submitted content is limited to losses legally attributable to your conduct; no automatic or unlimited indemnity is imposed.
17. Governing law and changes
Ontario law and applicable federal Canadian law govern these terms, subject to mandatory protections that apply to you. If a provision is unenforceable, the remaining provisions continue where lawful. Updated terms apply prospectively; the version accepted for an existing order remains part of that transaction unless lawfully agreed otherwise.
